NEW CINGULAR WIRELESS SEVICES, INC.; AT&T CORP.

on behalf of those who allege claims for unfair business practices, fraud and deceit towards California consumers, entered into cellular service contracts with AT&T prior to AT&T being acquired by Cingular on October 26, 2004. Cingular and AT&T merged to form one wireless phone service company, which significantly and materially degraded the cellular telephone service for AT&T customers. The suit asks for punitive damages, cypres recovery, permanent injunctive relief, compensatory damages, consequential damages, exemplary damages, and restitution for the loss of benefits earned by Plaintiff(s), restitution and disgorgement of money received by Defendants as a result of their wrongful conduct, attorneys' fees, pre-judgment interest, and costs of suit.
