STEVE GALFANO, Individually and Representatives for all others similarly situated and the General Public. This is a national class action against:

BLOCKBUSTER, INC.

on behalf of those who allege claims against Blockbuster, Inc. for wrongfully and unfairly deceiving its customers by advertising, promoting, and marketing of the rental of movies with "no more late fees" since January 2005, but actually charging its members the full price of the rental on the eight day after the end of the rental period; crediting back the amount for the rental towards their Blockbuster account instead of their credit card if the rental movie was returned with 30 days of the sale date; and charging a restocking fee for rentals that are returned eight days after the end of the rental period but before the 30 days of the sale date. Blockbuster, Inc., a publicly traded subsidiary of Viacom, Inc. is the self-proclaimed "world's leading renter of videos, DVDs, and video games," with stores all across the nation. The suit asks for permanent injunctive relief, equitable relief, damages suffered by Plaintiffs and the members of the Class, attorneys' fees, and costs of suit.
