Thomas A. Gross, Individually and as Representative for all others similarly situated v. Desert Automotive, LLC., a Delaware Limited Liability Company, dba Champion Cadillac Chevrolet, Results Plus Marketing, Inc., a Virginia Corporation, this is a California class action against:
CHAMPION CADILLAC CHEVROLET
on behalf of all those who allege to have been wrongfully and unfairly deceived by Champion Cadillac Chevrolet in receiving postcards from Champion in 2004, informing them that they had won a prize and those individuals who had responded to Champion to claim the prize. Champion offered that if those who received the postcard came to the Champion showroom, they would receive a free Gateway computer or other specified prize, but instead they did not have any prizes available for pick up at the dealership nor did they have certificates for prizes that it represented that it was actually awarding. Champion had no intention of providing the promised prizes to Plaintiff and the members of the Class. The suit asks for punitive damages, exemplary damages, permanent injunctive relief, cy pres recovery, compensatory and consequential damages, treble damages, restitution for loss of benefits earned by Plaintiff(s), restitution and disgorgement of money received by Defendants as a result of their wrongful conduct and attorney's fees.
